TERMS & CONDITIONS

Visiting or browsing this site constitutes acceptance of the terms of use, without qualification or limitation. Do not use this site if you do not agree to the terms of use. We reserve the right to modify, add, or remove portions of these terms and conditions or the privacy policy at any time. Any changes shall become effective immediately upon posting on the relevant pages of Harper Rose Skin. It is the responsibility of site visitors to periodically check for changes to these terms of use or privacy policy. Continued use of this site following the posting of terms of use or privacy policy changes is construed as acceptance of those changes.

GENERAL

This Website is owned and operated by Taki Trading Company Ltd, a registered company in New Zealand trading as Harper Rose Skin (hereinafter HRS) at www.harperroseskin.com with the customer (hereinafter CUSTOMER).

HRS does not accept any deviating terms and conditions of the CUSTOMER unless we agree to these explicitly and in writing. The terms and conditions listed below are directed only at CUSTOMERS who are users, which means people who conclude legal transactions for a purpose attributed to personal and non-commercial use only.

By using this Website, you warrant that:

  • You are legally capable of entering into binding contracts
  • You are at least 18 years of age
  • The personal information you are required to provide when you register is true, accurate, current, and complete in all respects; and you are not impersonating any other person or entity.

ORDERS

The products sold on the Website are not for resale or distribution. We reserve the right to cancel orders and/or suspend accounts where we believe products are being ordered in breach of this provision.

You will assume the risk for the products once they have been delivered to the delivery address which you specified when ordering the products. We accept no liability where you provide an incorrect delivery address or where you fail to collect the products from the delivery address you specified.

E-BOOKS AND DIGITAL GOODS

The purchase of all digital products, E-books, PDF-downloads, and any other online content is subject to the following terms and conditions. All CUSTOMERS are advised to read these terms and conditions carefully before making any purchase.
All digital products, E-books, PDF-downloads, resource material, videos, and any other online content are subject to copyright protection. Each of them is licensed to a single user only. CUSTOMERS are not allowed to copy, distribute, share, and/or transfer the purchased product(s) to any third party or person. HRS may encrypt, password protect, and/or stamp license details (including customer name, address, etc.) on its digital products to ensure additional safety.

All transactions concerning the purchase of intangible products, E-books, PDF-downloads, resource material, videos, and online content are made through payment gateways that use SSL encryption. These payment gateways are safe and secure for using all types of credit cards and debit cards in different countries.
In case you are not redirected back to our website after your purchase or you do not receive an email from us with a link to your purchased product, you can contact us immediately with your transaction details, including the email address used for payment. We will supply you with your product details and download link as soon as possible.

All purchases made on www.harperroseskin.com are non-refundable. Since the products made available here are intangible, we cannot accept any request for refunds. In case of an erroneous purchase, please contact us via contact@harperroseskin.com to reach an agreement.

By placing an order, you warrant that you are at least 18 years old (or have your parents' permission to buy from us) and accept these terms and conditions, which shall apply to all orders placed. None of these terms and conditions affects your statutory rights. No other terms or changes to the terms and conditions shall be binding unless agreed in writing signed by us.

PAYMENT

HRS accepts only the payment methods stated on the web portal during the order process. The CUSTOMER independently chooses the preferred way of paying among the offered payment methods.

During the payment process, the CUSTOMER can choose between the following payment options:

  • If a payment via credit card is selected, by submitting their credit card data, the CUSTOMER authorizes us to charge the respective credit card company with the full price, including any possible shipping and handling fees, on the due date. The charge is prompted upon order confirmation.
  • If payment via PayPal is selected, the CUSTOMER must have a PayPal account and verify their identity by submitting their access data. Thereafter, the CUSTOMER must complete the PayPal payment process and confirm the payment.

HRS may assess credit risks where legally permitted and in due consideration of both the CUSTOMER's and our interests. We reserve the right to exclude certain payment methods for first-time and follow-up orders depending on the credit risk assessment.
To ensure that your credit, debit, or charge card is not being used without your consent, we will validate your name, address, and other personal information supplied during the order process against appropriate third-party databases.

LIABILITY

The CUSTOMER's claims to damages or compensation of frustrated expenditures against HRS are directed in accordance with these terms. Our liability, regardless of the legal basis for the CUSTOMER'S claims, shall be excluded unless the damage arose due to intent or gross negligence on our part, by our employees, legal representatives, or vicarious agents. If our liability is excluded or limited, the same applies to the personal liability of our employees, legal representatives, or vicarious agents.

We accept liability in accordance with statutory law for damages resulting from injury to life, limb, or health, due to intentional or gross negligence on our part, by our legal representatives, employees, or vicarious agents.

In particular, we disclaim all liabilities in connection with the following:

  • Incompatibility of the website with any of your equipment, software, or telecommunications links
  • Technical problems, including errors or interruptions of the website
  • Unsuitability, unreliability, or inaccuracy of the website
  • Failure of the website to meet your requirements.

DATA STORAGE AND DATA PROTECTION

The CUSTOMER acknowledges and consents to HRS storing the CUSTOMER'S personal data necessary for processing an order. The CUSTOMER explicitly consents to the collection, processing, and use of their personal data. Stored personal data will be treated confidentially.

The CUSTOMER has the right to revoke their consent with future effect. In such a case, we are obliged to erase or block personal data in accordance with applicable data protection regulations.

IMAGE RIGHTS

The CUSTOMER may provide us with a current picture of themselves, which is optional and serves solely to provide an optimum analysis of the CUSTOMER'S condition. Should the CUSTOMER provide a picture that they do not have the copyright for, we exclude any liability.

RISKS OF PRODUCT USE

This website’s content is not a substitute for direct, personal, professional medical care and diagnosis. None of the products from HRS should be used without clearance from your physician or healthcare provider. The information on this website is not intended to provide specific physical or mental health advice or any other advice for individuals or companies and should not be relied upon in that regard. There may be risks in taking products from HRS for people in poor health or with pre-existing physical or mental health conditions. If the CUSTOMER neglects these risks, it is the CUSTOMER'S own free will and accord, knowingly and voluntarily assuming all risks. These risks may also exist for those currently in good health. Such risks should be clarified with a physician first.

TYPOGRAPHICAL ERRORS

HRS is not responsible for any typographical errors, including representation of products and prices. Harper Rose Skin may make improvements and/or changes to products and/or programs described on this website at any time without notice. Harper Rose Skin assumes no responsibility for the accuracy of the information on its website. Use of such information is at the recipient’s own risk.

The linked sites are not under the control of HRS, and HRS is not responsible for the contents of any linked sites, any changes to or updates of such sites. GOVERNING JURISDICTION

These Terms are governed by the laws in force in New Zealand, and you agree to submit to the exclusive jurisdiction of the courts of that jurisdiction. For our exclusive benefit, we retain the right to bring proceedings in the courts of your residence.
